RAJLO Terms of Service

Welcome to RAJLO — Jamaica’s First Cashless Transportation Platform.

These Terms of Service (“Terms”) govern your access to and use of the RAJLO platform, mobile applications, websites, software, payment systems, communication systems, and related services (collectively, the “Platform”).

By accessing, downloading, registering for, or using the RAJLO Platform, you agree to be legally bound by these Terms.

If you do not agree to these Terms, you may not use the Platform.

1. Definitions

For purposes of these Terms:

“RAJLO” refers to the company, platform, affiliates, owners, operators, licensors, employees, contractors, and related entities.
“User” refers to any rider, driver, visitor, or person using the Platform.
“Driver” refers to independent third-party transportation providers using the Platform.
“Rider” refers to any person requesting transportation services through the Platform.
“Services” refers to technology services, software systems, payment systems, communication systems, and marketplace services provided by RAJLO.

2. Nature of the Platform

2.1 Technology Platform Only

RAJLO is a technology marketplace platform that connects riders with independent third-party transportation providers.

RAJLO:

Does not own or operate vehicles
Does not provide transportation services directly
Does not employ drivers
Does not control driver conduct
Does not guarantee ride availability
Does not guarantee service quality or uninterrupted operation
All transportation services are independently provided by third-party drivers.

2.2 Independent Contractor Relationship

Drivers are independent contractors and are not employees, agents, representatives, or partners of RAJLO.

Nothing in these Terms creates:

Employment relationships
Joint ventures
Partnerships
Agency relationships

3. Eligibility

To use the Platform, users must:

Be legally capable of entering binding agreements
Provide accurate account information
Maintain valid payment methods where required
Comply with Jamaican laws and regulations
Comply with all Platform policies
RAJLO reserves the right to refuse service to any person at its sole discretion.

4. User Accounts

4.1 Account Responsibility

Users are responsible for:

Maintaining account confidentiality
Protecting login credentials
Protecting OTP verification codes
Restricting unauthorized access to devices
All activity occurring under their account

4.2 Accurate Information

Users must provide accurate and current information at all times.

RAJLO may suspend or terminate accounts containing false, misleading, or fraudulent information.

5. RAJLO Services

RAJLO currently supports:

5.1 RAJLO Private Ride

An on-demand private transportation service connecting riders with independent drivers.

5.2 RAJLO Route

A route-based transportation service utilizing Jamaican route taxi systems and fare structures.

RAJLO reserves the right to modify, suspend, expand, or discontinue services at any time.

6. Cashless Payment System

6.1 Electronic Payments

RAJLO operates as a fully cashless transportation platform.

By using the Platform, users authorize RAJLO and its payment processors to:

Charge payment methods
Process trip fares
Apply cancellation fees
Apply service fees
Process refunds where applicable

6.2 Fare Estimates

Displayed fares are estimates only and may change due to:

Traffic conditions
Route changes
GPS recalculations
Wait times
Technical adjustments
Service demand
Final fares are determined at trip completion.

6.3 Payment Failures

RAJLO reserves the right to:

Retry failed payments
Restrict account access
Suspend accounts
Refer unpaid balances for collections

7. Cancellation Policies

Users agree that cancellation fees may apply depending on:

Driver travel distance
Wait times
Timing of cancellation
Service category
Platform demand
Detailed cancellation rules are governed by separate Rider and Driver Policies.

8. User Conduct

Users agree not to:

Violate Jamaican laws
Harass or threaten others
Engage in discrimination
Commit fraud
Manipulate fares or routes
Use fake GPS systems
Abuse promotions
Damage vehicles or property
Reverse engineer the Platform
Use bots or unauthorized automation
Share accounts without authorization
Engage in criminal activity
RAJLO reserves the right to investigate violations and take enforcement action.

9. Driver Conduct & Responsibilities

Drivers are solely responsible for:

Vehicle operation
Vehicle maintenance
Insurance coverage
Licensing and permits
Compliance with Jamaican laws
Passenger interactions
Taxes and operating expenses
Drivers assume all risks associated with transportation services.

10. Rider Responsibilities

Riders are responsible for:

Providing accurate pickup information
Maintaining valid payment methods
Following safety instructions
Respectful behavior toward drivers
Compliance with Jamaican laws
Riders assume all risks associated with transportation services.

11. Safety Disclaimer

Transportation services involve inherent risks.

RAJLO cannot guarantee:

Driver behavior
Passenger behavior
Vehicle safety
Route safety
Background check accuracy
Crime prevention
Emergency response outcomes
Technical reliability
Users voluntarily assume all risks associated with use of the Platform.

12. Lost Property

Users are solely responsible for their belongings.

RAJLO is not responsible for:

Lost items
Stolen property
Damaged belongings
Unclaimed property left in vehicles
RAJLO may attempt to facilitate communication between parties but does not guarantee item recovery.

13. Technical Services Disclaimer

RAJLO does not guarantee uninterrupted or error-free operation of:

Mobile applications
GPS systems
Payment systems
Notifications
Mapping services
Communication systems
Mobile networks
Servers or cloud infrastructure
The Platform is provided “as is” and “as available” without warranties of any kind.

14. Limitation of Liability

To the fullest extent permitted under Jamaican law:

RAJLO, its owners, affiliates, officers, directors, employees, contractors, licensors, and service providers shall not be liable for:

Personal injury
Death
Property damage
Emotional distress
Lost profits
Lost income
Vehicle damage
Delays
Missed appointments
Driver negligence
Passenger misconduct
Criminal acts
Service interruptions
Technical failures
GPS inaccuracies
Data breaches beyond reasonable control
Third-party disputes
Government actions
Force majeure events
Users use the Platform entirely at their own risk.

15. Indemnification

Users agree to defend, indemnify, and hold harmless RAJLO and its affiliates from claims, liabilities, damages, losses, legal fees, fines, and expenses arising from:

Violations of these Terms
Violations of Jamaican law
User misconduct
Fraudulent activity
Damage caused to third parties
Unauthorized account activity

16. Intellectual Property

All Platform content, including:

Software
Logos
Branding
Trademarks
Designs
Interfaces
Graphics
Features
Systems
remain the exclusive property of RAJLO.
Users may not copy, modify, distribute, reverse engineer, or exploit Platform content without written authorization.

17. Privacy

Use of the Platform is also governed by the RAJLO Privacy Policy.

Users acknowledge that RAJLO may collect and process:

GPS location data
Device information
Payment information
Trip history
Communication records
Usage analytics
for operational, security, fraud prevention, legal, and business purposes.

18. Fraud Prevention & Enforcement

RAJLO reserves the right to investigate:

Fake trips
Chargeback fraud
Referral abuse
GPS manipulation
Fake accounts
Payment fraud
Threatening behavior
Promotional abuse
RAJLO may suspend or permanently deactivate accounts at its sole discretion.

19. Account Suspension & Termination

RAJLO reserves the right to suspend, restrict, or terminate accounts at any time for:

Policy violations
Fraudulent activity
Safety concerns
Payment issues
Legal compliance concerns
Criminal activity
Abuse of the Platform
RAJLO may take action without prior notice where necessary.

20. Force Majeure

RAJLO shall not be liable for delays, failures, or interruptions caused by events beyond its reasonable control, including:

Natural disasters
Hurricanes
Flooding
Government actions
Civil unrest
Internet outages
Power failures
Mobile network failures
Cyberattacks
Transportation disruptions

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Jamaica.

Any disputes arising from these Terms or use of the Platform shall be subject to the jurisdiction of the courts of Jamaica.

22. Dispute Resolution

Users agree to attempt to resolve disputes with RAJLO informally before initiating legal proceedings.

RAJLO reserves the right to require mediation, arbitration, or alternative dispute resolution procedures where permitted by law.

23. Modifications to Terms

RAJLO reserves the right to modify these Terms at any time without prior notice.

Continued use of the Platform following updates constitutes acceptance of the revised Terms.

24. Entire Agreement

These Terms, together with related Platform policies, constitute the entire agreement between users and RAJLO concerning use of the Platform.

25. User Acknowledgment

By using the RAJLO Platform, users acknowledge and agree that they:

Have read and understood these Terms
Accept all risks associated with third-party transportation services
Understand that drivers are independent contractors
Agree to comply with Jamaican laws and Platform policies
Release RAJLO from liability to the fullest extent permitted under Jamaican law

This document forms part of your agreement with RAJLO. By continuing to use the RAJLO platform you accept this policy as currently published. RAJLO records the version of each policy you accept, with a timestamp, for both parties' protection.
