RAJLO Safety Disclaimer & Emergency Policy

Welcome to RAJLO — Jamaica’s First Cashless Transportation Platform.

This Safety Disclaimer & Emergency Policy (“Policy”) governs safety-related matters, emergency procedures, user responsibilities, and liability limitations associated with the use of the RAJLO platform, mobile applications, websites, communication systems, and related services (collectively, the “Platform”).

By using the Platform, riders, drivers, and all users acknowledge and accept the risks associated with third-party transportation services and agree to comply with this Policy.

1. Technology Platform Disclaimer

1.1 RAJLO Is a Technology Platform

RAJLO is a technology marketplace platform that connects riders with independent third-party transportation providers.

RAJLO:

  • Does not provide transportation services directly
  • Does not employ drivers
  • Does not own or operate vehicles
  • Does not supervise trips in real time
  • Does not control driver behavior or route decisions
  • Does not guarantee ride availability or uninterrupted service
  • All transportation services are independently provided by third-party drivers.

1.2 Independent Contractor Drivers

Drivers using the Platform are independent contractors and are not employees, agents, or representatives of RAJLO.

Drivers are solely responsible for:

  • Vehicle operation
  • Driving decisions
  • Passenger interactions
  • Vehicle safety and maintenance
  • Compliance with Jamaican laws
  • Insurance obligations

2. Assumption of Risk

Transportation services involve inherent risks.

By using the Platform, users voluntarily assume all risks associated with:

  • Vehicle accidents
  • Traffic incidents
  • Driver negligence
  • Passenger misconduct
  • Criminal acts
  • Road hazards
  • Weather conditions
  • Delays
  • Vehicle malfunctions
  • Technical failures
  • GPS inaccuracies
  • Mobile network interruptions
  • Emergency response limitations
  • Users use the Platform entirely at their own risk.

3. No Guarantee of Safety

While RAJLO strives to promote safer transportation experiences, RAJLO cannot guarantee:

  • Driver behavior
  • Rider behavior
  • Passenger conduct
  • Vehicle safety
  • Crime prevention
  • Background check accuracy
  • Identity verification accuracy
  • Emergency response outcomes
  • GPS accuracy
  • Mobile network reliability
  • Safe pickup or drop-off locations
  • Continuous tracking accuracy
  • Prevention of accidents or criminal activity
  • RAJLO makes no warranties regarding user safety.

4. Background Check Disclaimer

Where background checks, identity verification, or document reviews are conducted, users acknowledge that:

  • Such reviews may be limited in scope
  • Information may be incomplete, outdated, inaccurate, or unavailable
  • Criminal records may not always be discoverable
  • Future conduct cannot be predicted
  • RAJLO does not guarantee the suitability, safety, or reliability of any driver, rider, or user.

5. GPS & Tracking Limitations

RAJLO may use GPS, mapping systems, and real-time tracking technologies for operational purposes.

However, users acknowledge that:

  • GPS systems are not always accurate
  • Location updates may be delayed
  • Tracking systems may fail
  • Mobile networks may experience outages
  • Device limitations may impact location accuracy
  • Real-time monitoring may not function continuously
  • RAJLO is not responsible for losses or incidents arising from inaccurate or interrupted location services.

6. Emergency Situations

6.1 Emergency Services

In emergencies involving:

  • Accidents
  • Assaults
  • Threats
  • Medical emergencies
  • Criminal activity
  • Immediate danger
  • users should immediately contact Jamaican emergency services or law enforcement.

6.2 RAJLO Support Limitations

RAJLO may provide limited support assistance where reasonably possible.

However, RAJLO:

  • Is not an emergency response provider
  • Does not guarantee immediate intervention
  • Does not guarantee monitoring of emergency reports in real time
  • Does not guarantee emergency communication delivery
  • Does not guarantee emergency response outcomes
  • Users should not rely solely on the Platform during emergencies.

7. Driver Safety Responsibilities

Drivers are solely responsible for:

  • Safe vehicle operation
  • Following Jamaican traffic laws
  • Maintaining vehicle roadworthiness
  • Maintaining legally required insurance
  • Avoiding impaired or distracted driving
  • Making lawful and safe driving decisions
  • Determining whether conditions are safe to continue a trip
  • Drivers may refuse or cancel trips where safety concerns reasonably exist.

8. Rider Safety Responsibilities

Riders are responsible for:

  • Providing accurate pickup information
  • Entering and exiting vehicles safely
  • Wearing seatbelts where available
  • Following reasonable safety instructions
  • Avoiding unsafe or unlawful behavior
  • Protecting personal belongings
  • Riders should use reasonable judgment when interacting with drivers and using transportation services.

9. Safe Pickup & Drop-Off Locations

Users are responsible for selecting reasonably safe and legally accessible pickup and drop-off locations.

Drivers may refuse pickups or drop-offs where:

  • Conditions appear unsafe
  • Traffic laws prohibit stopping
  • Criminal activity is suspected
  • Environmental hazards exist
  • Road conditions are dangerous
  • RAJLO is not responsible for incidents occurring at pickup or drop-off locations.

10. Vehicle & Personal Property Disclaimer

RAJLO is not responsible for:

  • Vehicle defects
  • Mechanical failures
  • Lost or stolen property
  • Damaged belongings
  • Unattended items left in vehicles
  • Third-party theft
  • Users are solely responsible for protecting their personal property.

11. Technical Systems Disclaimer

RAJLO does not guarantee uninterrupted operation of:

  • Mobile applications
  • GPS systems
  • Mapping services
  • Communications systems
  • Notifications
  • Emergency features
  • Payment systems
  • Cloud infrastructure
  • Mobile carrier networks
  • Technical failures, outages, delays, or inaccuracies may occur.
  • The Platform is provided “as is” and “as available” without warranties of any kind.

12. Prohibited Conduct

Users may not:

  • Threaten or harass others
  • Engage in violence
  • Carry illegal weapons or contraband
  • Operate vehicles while impaired
  • Use the Platform for criminal activity
  • Engage in stalking or intimidation
  • Share accounts without authorization
  • Manipulate GPS or tracking systems
  • Engage in fraudulent behavior
  • RAJLO reserves the right to suspend or permanently ban users violating Platform safety rules.

13. Reporting Safety Concerns

Users are encouraged to report:

  • Unsafe driving
  • Harassment
  • Criminal activity
  • Fraudulent behavior
  • Vehicle safety concerns
  • Threats or misconduct
  • RAJLO reserves the right to investigate reports at its sole discretion.
  • False or fraudulent reports may result in account suspension.

14. Account Suspension & Deactivation

RAJLO reserves the right to suspend, restrict, or permanently deactivate accounts where:

  • Safety concerns arise
  • Fraud is suspected
  • Criminal activity is reported
  • Platform rules are violated
  • User behavior creates unreasonable risk
  • RAJLO may take enforcement action without prior notice where necessary to protect users or Platform integrity.

15. Limitation of Liability

To the fullest extent permitted under Jamaican law:

RAJLO, its owners, affiliates, officers, directors, employees, contractors, licensors, and service providers shall not be liable for:

  • Personal injury
  • Death
  • Vehicle accidents
  • Assaults
  • Criminal acts
  • Kidnapping
  • Theft
  • Property damage
  • Emotional distress
  • Driver negligence
  • Rider misconduct
  • Third-party conduct
  • Emergency response failures
  • GPS inaccuracies
  • Technical failures
  • Mobile network outages
  • Background check limitations
  • Lost profits or financial losses
  • Off-platform interactions
  • Users use the Platform entirely at their own risk.

16. Indemnification

Users agree to defend, indemnify, and hold harmless RAJLO and its affiliates from claims, liabilities, damages, legal expenses, or losses arising from:

  • User misconduct
  • Criminal activity
  • Violations of Jamaican law
  • Unsafe behavior
  • Violations of this Policy
  • Vehicle operation or transportation services

17. Policy Updates

RAJLO reserves the right to modify or update this Policy at any time without prior notice.

Continued use of the Platform following updates constitutes acceptance of the revised Policy.

18. Governing Law

This Policy shall be governed by and interpreted in accordance with the laws of Jamaica.

Any disputes relating to this Policy shall be subject to the jurisdiction of the courts of Jamaica.

19. User Acknowledgment

By using the RAJLO Platform, users acknowledge and agree that they:

  • Have read and understood this Policy
  • Understand the risks associated with third-party transportation services
  • Accept that RAJLO cannot guarantee user safety
  • Understand the limitations of GPS, tracking, and emergency systems
  • Voluntarily assume all risks associated with Platform use
  • Release RAJLO from liability to the fullest extent permitted under Jamaican law

This document forms part of your agreement with RAJLO. By continuing to use the RAJLO platform you accept this policy as currently published. RAJLO records the version of each policy you accept, with a timestamp, for both parties' protection.
